Immigration Lawyer Darwin

The whole of the Northern Territory is a designated regional area, and the NT has its own DAMA. For skilled workers and Territory employers, that combination opens visa pathways the big cities cannot offer.

Our offices are in Sydney and Melbourne, not Darwin. We act for Darwin clients by video call, or in person if you are ever in Sydney or Melbourne, and our fees are fixed so you know the cost up front.

How we help Darwin clients

The NT DAMA

For Territory employers whose roles do not fit the standard sponsorship programs. The Northern Territory DAMA can open different occupation and concession options, and the employer needs endorsement before lodging. We help you check the fit and prepare the request.

Learn more

Employer sponsorship

For Darwin businesses hiring overseas staff. The NT's regional status means the Subclass 494 sits alongside the 482 and 186. We handle sponsor approval, nominations and the worker's visa, and the obligations that continue after the grant.

Learn more

Regional skilled visas

For skilled workers using the NT's Category 3 regional status. The Subclass 491 is available with NT nomination or an eligible relative sponsor. We help with points, skills assessments and Expressions of Interest, and later with the permanent Subclass 191.

Learn more

Partner visas

For couples applying onshore from Darwin or from overseas. We look at which partner visa applies, how your relationship evidence reads on paper, and what to organise before you lodge, including the onshore and offshore differences.

Learn more

Parent and family visas

For parents, children and other relatives joining family in the Territory. Each pathway has its own sponsor rules, costs and queue, so we compare the realistic options with you before you commit to one.

Learn more

Student visas and next steps

For students at Darwin providers who want to study, change course or plan what follows graduation. The rules for applying for a further Student visa onshore changed on 2 October 2026, so confirm your position before you lodge.

Learn more

Refusals and ART reviews

For anyone in Darwin holding a refusal or cancellation notice. We read the decision with you, confirm the review deadline and discuss whether a Tribunal review, or another option, is worth pursuing. Most onshore deadlines run for 28 days.

Learn more

Labour agreements

For Territory employers with roles the standard settings do not cover, including outside the DAMA's scope. A labour agreement is negotiated with the Department, so the early planning and the case you put forward both matter. We help prepare that case.

Darwin, the NT DAMA and Category 3 regional status

Darwin, the NT DAMA and Category 3 regional status

Every Northern Territory postcode, Darwin included, is a Category 3 designated regional area on the Home Affairs regional postcode list. Category 3 covers "Regional Centres and Other Regional Areas", and regional incentives apply to skilled migrants who settle there.

For a skilled worker, that status puts the Subclass 491 on the table with NT nomination or an eligible relative sponsor, with the permanent Subclass 191 able to follow. For a Darwin employer, the Subclass 494 regional employer visa sits alongside the standard 482 and 186.

The NT also has its own DAMA, the Northern Territory DAMA. A DAMA lets endorsed employers sponsor workers under labour agreements that use the 482, 494 and 186 visa programs, and it can offer occupations and concessions the standard settings do not. The employer needs endorsement from the Designated Area Representative before lodging a labour agreement request with the Department.

Our DAMA page explains the framework, and our guides to the 491, 494 and 191 cover the regional visas in detail.

NT nomination in plain terms

The Northern Territory's nomination program is NT General Skilled Migration. Nomination supports a Subclass 190 or 491, but it is not a visa, and Home Affairs still decides the application, including the health, character and other criteria.

You normally need an Expression of Interest in SkillSelect first. Programs open and close during the year and criteria change, so we have not repeated any settings here. Check the current position on the NT Government migration website.

Where we help is the comparison: NT nomination against another state or territory, against the Subclass 189, or against employer sponsorship through the 482, 494 or the NT DAMA. Our guide to state nomination in 2026 compares the programs, and our skilled visas page covers the pathways.

Tina and Deepika have guided me through, what felt to me, like a complex case. They answered my endless questions with empathy and used terms I would understand. I was lacking confidence of the process at times, but I was reassured by both of them when needed. Overall a pleasure to work with. Thank you for getting me over every hurdle that popped up and managing to have all our visas granted in such a short amount of time. I am so glad that I found Tina again, I was also so pleased to find she had her own law firm from the last time we spoke. Very well deserved.

We had the pleasure of working with Tina and her team recently. My partner and I were in a very stressful situation due to a sudden change in our circumstances. Tina gave us a clear plan, spent enough time addressing our concerns, and kept us informed throughout the process. She and her team helped us effectively with my wife's visa within a very short timeframe. I would strongly recommend One Planet Migration Law.

Tina’s help was indispensable when I began the process of moving to Australia. She helped my husband and I work through the paperwork and gain clarity on what was needed. Without her, the process would have been so much more difficult. We’re very grateful for her assistance, which she carried out professionally, responsiveness, clarity and joy

So great at their jobs. Absolutely a dream to work with. These people go above and beyond and as a Canadian lawyer myself, I cannot think of another time I've worked professionally with people who are so kind, diligent, and competent. I cannot recommend One Planet enough.

I’m incredibly grateful to Tina Masrour, Deepika, and Rhel from One Planet for their outstanding support with my parents’ Subclass 600 Tourist Visa application. Thanks to their expertise, professionalism, and attention to detail, both of my parents received their visas with a smooth and successful outcome. I truly appreciate their hard work, responsibility, and patience throughout the process. They were clear, responsive, and genuinely committed to helping us. I highly recommend One Planet Immigration to anyone in need of expert immigration assistance. Thank you again for everything!

Tina Masrour and the team at One Planet Migration Law were a great resource in guiding us through our application for migration to Australia. From the initial consultation, to getting my qualifications recognized by Engineers Australia and submitting an expression of interest on our behalf they demonstrated exceptional knowledge of the immigration process, providing clear and accurate guidance at every step. They took the time to understand our unique circumstances and tailored their advice accordingly. I would highly recommend them to anyone considering migration to Australia.

FAQ

Frequently asked questions

Do you have an office in Darwin?

No. Our offices are in Sydney, at Axis House, 81-83 Campbell Street, Surry Hills, and in Melbourne, on the Ground Floor at 470 St Kilda Road. We act for Darwin clients by video consultation, or in person if you are ever in Sydney or Melbourne. Your file does not depend on where you or your lawyer sit.

Is Darwin a designated regional area?

Yes. Every Northern Territory postcode, Darwin included, is a Category 3 regional area on the Home Affairs regional postcode list. That is what makes the Subclass 491 and 494 available across the Territory, with the permanent 191 able to follow. Category 3 is the broadest of the regional categories.

What is the NT DAMA and can my employer use it?

The Northern Territory DAMA is a labour agreement framework for Territory employers whose roles do not fit the standard sponsorship programs. The employer first needs endorsement from the Designated Area Representative, then lodges a labour agreement request. DAMA agreements use the 482, 494 and 186 programs. See our DAMA page or book a consultation to check whether your role fits.

Does NT nomination mean I will get a visa?

No. Nomination is one requirement for the Subclass 190 and 491. Home Affairs still decides the visa application, and you must still meet the health, character and other criteria. Places are limited and a nomination may never come, so treat it as one step in a longer process, not an outcome.

How much does an immigration lawyer cost for a Darwin matter?

It depends on the visa and how complex your situation is, not on where you live. Our fees are fixed, so once we understand your matter you know the cost up front, and we explain what the fee covers before you commit. Government visa charges and any assessment fees are separate.

Should I use a lawyer or a migration agent in Darwin?

Both can give immigration assistance if properly authorised. A lawyer is an Australian legal practitioner holding a practising certificate, and what you tell a lawyer is generally protected by legal professional privilege. Whoever you engage, check their authorisation first. Home Affairs publishes a consumer guide for legal practitioners. That check applies to us too.

My visa was refused. How long do I have to apply for review?

For most onshore refusals the Administrative Review Tribunal time limit is generally 28 days from being notified, shorter if you are in immigration detention, and the Tribunal cannot extend it. Your decision letter states your deadline, so read it carefully and contact a lawyer as soon as you receive it. Hearings may be held by video or phone.

How does the 491 lead to permanent residence from Darwin?

The Subclass 491 is a five-year provisional visa for living and working in a designated regional area, which covers the whole NT. After meeting the visa's conditions over the required period, you may be eligible for the Subclass 191, which is permanent. The detail matters, so read our 191 guide and talk to us before you plan around it.
