Immigration Lawyer Adelaide

Adelaide has two things most capitals do not: designated regional area status and its own DAMA. If you are a skilled worker or a South Australian employer, those two facts can widen your visa options considerably.

Our offices are in Sydney and Melbourne, not Adelaide. We act for Adelaide clients by video call, or in person if you are ever in Sydney or Melbourne, and our fees are fixed so you know the cost up front.

How we help Adelaide clients

The Adelaide DAMA

For Adelaide employers whose roles sit outside the standard sponsorship programs. The Adelaide City Technology and Innovation Advancement DAMA can open different occupation and concession options. We help you check whether it fits and prepare the endorsement and agreement steps.

Learn more

Employer sponsorship

For Adelaide businesses hiring overseas staff. Regional status means the Subclass 494 is available here alongside the 482 and 186. We manage sponsor approval, nominations and the worker's visa, and we explain the obligations your business takes on after the grant.

Learn more

Regional skilled visas

For skilled workers looking at the Subclass 491 with South Australian nomination or an eligible relative sponsor. We help with points, skills assessments and Expressions of Interest, and later with the Subclass 191 permanent visa that can follow time on the 491.

Learn more

Partner visas

For couples applying onshore from Adelaide or from overseas. We look at which partner visa applies, how your relationship evidence reads on paper, and what to organise before you lodge. We also explain how onshore and offshore applications are treated differently.

Learn more

Parent and family visas

For parents, children and other relatives joining family in South Australia. Each family pathway has its own sponsor rules, costs and queue, so we compare the realistic options with you before you commit.

Learn more

Student visas and next steps

For students at Adelaide providers who want to study, change course or plan what comes after graduation. The rules for applying for a further Student visa onshore changed on 2 October 2026, so confirm your position before you lodge anything further.

Learn more

Refusals and ART reviews

For anyone in Adelaide holding a refusal or cancellation notice. We read the decision with you, confirm the review deadline and discuss whether a Tribunal review, or another option, is worth pursuing. Most onshore refusal deadlines run for 28 days and cannot be extended.

Labour agreements

For South Australian employers with roles the standard settings do not cover, including outside DAMA areas. A labour agreement is negotiated with the Department, so the early planning and the case you put forward both matter.

The Adelaide DAMA: what it is and who it is for

The Adelaide DAMA: what it is and who it is for

Adelaide is covered by the Adelaide City Technology and Innovation Advancement DAMA, with Skilled and Business Migration, part of the South Australian Government, acting as the Designated Area Representative. Regional South Australia has a separate agreement, the South Australia Regional DAMA.

A DAMA sits on top of the employer-sponsored visa system and can offer occupations and concessions that the standard settings do not. DAMA labour agreements use the Subclass 482, 494 and 186 visa programs.

The sequence matters:

  1. The employer seeks endorsement from the Designated Area Representative.
  2. With endorsement, the employer lodges a labour agreement request with the Department of Home Affairs.
  3. Once the agreement is in place, the business sponsors workers under its terms.

Home Affairs is currently supporting a transition to state and territory-led DAMAs, so the detail of these agreements is evolving. Our DAMA page explains the framework, our guide to DAMA regions across Australia shows where agreements sit, and the Home Affairs DAMA page has the official position.

For an Adelaide employer, the practical question is usually whether to sponsor under the standard programs or pursue the DAMA. That comparison is what a first consultation is for.

Adelaide's regional status and SA nomination

Adelaide is a Category 2 designated regional area, one of Home Affairs' "Cities and Major Regional Centres". For a skilled worker that means the Subclass 491 is available here, and the permanent Subclass 191 can follow. For an employer it means the Subclass 494 sits alongside the 482 and 186. Our guides to the 491, 494 and 191 explain how the regional system fits together.

South Australia's nomination program is run by Skilled and Business Migration. Nomination supports a Subclass 190 or 491 but is not a visa, and Home Affairs still decides the application. Programs open and close during the year and criteria change, so read the current position on the Skilled and Business Migration website.

Where we add value is the comparison: SA nomination against another state, against the 189, or against employer sponsorship through the 482, 494 or the Adelaide DAMA.

Tina and Deepika have guided me through, what felt to me, like a complex case. They answered my endless questions with empathy and used terms I would understand. I was lacking confidence of the process at times, but I was reassured by both of them when needed. Overall a pleasure to work with. Thank you for getting me over every hurdle that popped up and managing to have all our visas granted in such a short amount of time. I am so glad that I found Tina again, I was also so pleased to find she had her own law firm from the last time we spoke. Very well deserved.

We had the pleasure of working with Tina and her team recently. My partner and I were in a very stressful situation due to a sudden change in our circumstances. Tina gave us a clear plan, spent enough time addressing our concerns, and kept us informed throughout the process. She and her team helped us effectively with my wife's visa within a very short timeframe. I would strongly recommend One Planet Migration Law.

Tina’s help was indispensable when I began the process of moving to Australia. She helped my husband and I work through the paperwork and gain clarity on what was needed. Without her, the process would have been so much more difficult. We’re very grateful for her assistance, which she carried out professionally, responsiveness, clarity and joy

They took the time to understand our unique circumstances and tailored their advice accordingly. I would highly recommend them to anyone considering migration to Australia.

FAQ

Frequently asked questions

Do you have an office in Adelaide?

No. Our offices are in Sydney, at Axis House, 81-83 Campbell Street, Surry Hills, and in Melbourne, on the Ground Floor at 470 St Kilda Road. We act for Adelaide clients by video consultation, or in person if you are ever in Sydney or Melbourne. Your location does not limit what we can do on your file.

Is Adelaide a designated regional area?

Yes. Adelaide is a Category 2 regional area, one of the "Cities and Major Regional Centres" on the Home Affairs regional postcode list. That status is what makes the Subclass 491 and 494 available in Adelaide, with the permanent Subclass 191 able to follow.

What is the Adelaide DAMA?

The Adelaide City Technology and Innovation Advancement DAMA is a labour agreement framework covering Adelaide, with Skilled and Business Migration, part of the South Australian Government, as the Designated Area Representative. Employers need its endorsement before lodging a labour agreement request, and the agreement then uses the 482, 494 and 186 visa programs. Our DAMA page explains the mechanics in plain language.

How much does an immigration lawyer cost in Adelaide?

It depends on the visa and how involved your situation is, not on where you live. Our fees are fixed, so once we understand your matter you know the cost up front, and we set out what the fee covers before you decide. Government visa charges and any assessment fees are separate. Our fees guide for Adelaide and Perth has more detail.

Do I need a migration lawyer or a migration agent in Adelaide?

Either can give immigration assistance if properly authorised, and plenty of agents do good work. A lawyer is an Australian legal practitioner holding a practising certificate, and what you tell a lawyer is generally protected by legal professional privilege. Whoever you engage, check their authorisation first. Home Affairs publishes a consumer guide for legal practitioners.

Does South Australian nomination mean I will get a visa?

No. Nomination is one requirement for the Subclass 190 and 491. Home Affairs still decides the visa application, and you must still satisfy the health, character and other criteria. Places are limited and a nomination may never come, so treat it as one step in a longer process, not an outcome.

My visa was refused. How long do I have to apply for review?

For most onshore refusals the Administrative Review Tribunal time limit is generally 28 days from being notified of the decision, shorter if you are in immigration detention, and the Tribunal cannot extend it. Your decision letter states the deadline that applies to you, so read it carefully and contact a lawyer as soon as you receive it. Hearings may be held by video or phone.

Can an Adelaide employer sponsor a worker under the 494?

Yes, in principle. Adelaide is a designated regional area, so employers here can use the Subclass 494 regional employer-sponsored visa as well as the 482 and 186. Which route fits depends on the role, the worker and the business. Our employer sponsorship page covers the standard framework, and a consultation can compare the options for your situation.
